Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms for you. You may not use the Service if applicable law prohibits you from doing so.

2. App license and use of Hatch

The Hatch app is licensed to you under Apple's Standard Licensed Application End User License Agreement. These Terms govern Hatch's website, generation service, optional accounts, purchases, and other service features, and supplement rather than replace that app license. You may use Hatch only as permitted by these Terms, Apple's usage rules, and applicable law. All rights not expressly granted are reserved by us and our licensors.

3. Accounts

Hatch may offer optional sign-in by email or Sign in with Apple. You agree to provide accurate information, keep control of your sign-in method, protect your devices and login codes, and tell us promptly if you believe an account or session is compromised.

Usernames and display names must not impersonate others, mislead people, infringe rights, or violate these Terms. We may refuse, reclaim, or remove a name when reasonably necessary to protect users or the Service.

4. Your photos and other input

You retain all rights you already have in photos, names, and other content you submit to Hatch ("Input"). You give us a limited, worldwide, royalty-free license to host, copy, transmit, resize, moderate, transform, and otherwise process Input only as needed to provide, secure, troubleshoot, and comply with law for the Service. This license ends when the content is no longer reasonably needed for those purposes, subject to the retention rules in our Privacy Policy.

You represent that you own your Input or have all permissions needed to submit and transform it. A photo of another person may involve privacy, publicity, biometric, or other rights. Get permission before uploading someone else's photo, especially when the person is a minor.

A private sticker-board link is a capability. Anyone who receives or is forwarded that link may be able to submit Input until the board reaches its limit, expires, or is revoked. Contributors do not need an account. Each accepted contribution may automatically start one generation and make the completed pack available to both the contributor and the board creator.

5. Your generated stickers

As between you and FOF Labs, you own the sticker output generated specifically for your request to the extent that output can be owned under applicable law. To the extent FOF Labs obtains transferable rights in that output, we assign those rights to you. You may use, modify, share, and commercially use your generated output, subject to these Terms and the rights of people or intellectual property depicted in your Input or output.

You give us a limited, worldwide, royalty-free license to host, copy, process, transmit, and deliver your generated output only as needed to provide, secure, troubleshoot, and comply with law for the Service, or as you direct through sharing features. This license ends when the output is no longer reasonably needed for those purposes, subject to the retention rules in our Privacy Policy.

Hatch's software, name, icon, interface, design system, prompts, sticker recipes, effects, and other pre-existing materials remain owned by us or our licensors. Your output ownership does not transfer those underlying materials or give you a right to use Hatch branding.

Generative systems can produce unexpected, inaccurate, or similar results. We do not promise that an output will be unique, protectable by copyright, free of third-party claims, or suitable for a particular purpose. Review a sticker before publishing or using it commercially.

6. Acceptable use

You may not use Hatch to create, upload, or distribute content that:

• is unlawful, fraudulent, deceptive, threatening, or harassing;
• sexualizes or exploits a minor, or facilitates child abuse;
• violates privacy, publicity, intellectual-property, or other rights;
• impersonates a person in a misleading or harmful way;
• promotes violence, hateful conduct, self-harm, or illegal activity;
• contains malware or attempts to interfere with the Service; or
• evades moderation, quotas, payment rules, App Attest, or access controls.

You also may not probe, scrape, reverse engineer, overload, resell, or use automated means to access the Service except where applicable law expressly permits it. We may block a request or suspend access when we reasonably believe it violates these Terms or creates risk.

7. Eggs, purchases, and refunds

Hatch may offer consumable generation credits called "Eggs." An Egg authorizes either one eligible direct sticker-pack generation or one bounded private sticker board under the offer shown in the app. All accepted contributions within that board's disclosed limit are included in the board's one Egg. Receiving or saving a shared pack and contributing through someone else's board do not consume another Egg. Eggs are a limited license to use a feature. They are not money, property, a deposit, or a stored-value account; have no cash value; and cannot be sold or transferred except through a gifting feature Hatch expressly provides.

Purchases are processed by Apple and are also subject to Apple's terms. Prices, quantities, and taxes are shown before purchase. Except where required by law or Apple's policies, purchases are final. Request payment refunds through Apple. A direct generation consumes its Egg when the requested pack is successfully committed to your local sticker library. A board consumes its Egg once when the board is created; revoking, abandoning, deleting, or letting that board expire does not restore the Egg. Retrying, sharing, receiving, or saving does not add a charge.

Hatch restores a reserved Egg after a terminal technical failure, including when the app rejects a delivered bundle that does not satisfy the delivery contract. A deliberate customer cancellation after direct generation is admitted consumes the Egg even if no pack is delivered. A restored Egg is not a cash refund. If an Egg was received through Hatch's gifting feature, any payment refund goes only to the original purchaser through Apple.

Purchased Eggs do not expire. Promotional Eggs may have separate eligibility or expiration rules disclosed when granted.

8. Feedback

If you send ideas or feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation. This does not give us ownership of your photos or generated stickers.

9. Intellectual property and takedowns

The Service and its software, text, design, graphics, and other non-user materials are protected by intellectual-property laws. If you believe content created or shared through Hatch infringes your rights, contact support@hatchstickers.com with enough detail for us to evaluate the request.

10. Apple terms

These Terms are between you and FOF Labs, not Apple Inc. Apple is not responsible for Hatch or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of Hatch on Apple devices and may enforce those terms against you. Your use must also comply with the Apple Media Services Terms, the Standard Licensed Application End User License Agreement, and applicable App Store rules.

11. Changes, availability, and termination

We may add, change, suspend, or discontinue features, including generation models, limits, pricing, or supported platforms. We may suspend or terminate access if you violate these Terms, create risk, fail to pay applicable charges, or if law requires it.

Feature changes will not cause purchased Eggs to expire. If we permanently discontinue the generation feature while purchased Eggs remain, we will provide the remedy required by applicable law and Apple's policies.

You may stop using Hatch at any time. In-app account deletion permanently removes your optional Hatch profile, identity links, and sign-in sessions from Hatch's account system. When available, Hatch also revokes its Sign in with Apple authorization; older accounts may receive instructions to finish that revocation in Apple Account Settings. Account deletion or suspension does not remove packs, boards, publication capabilities, or Eggs that belong to this installation rather than the optional account. Any provisions that by their nature should survive termination will survive, including ownership, payment, warranty, liability, and dispute terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT HATCH WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT GENERATED OUTPUT WILL MEET YOUR EXPECTATIONS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOF LABS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF FIVE U.S. DOLLARS ($5.00) OR THE AMOUNT YOU PAID US FOR HATCH DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FOF Labs and its affiliates, officers, employees, and agents from claims, damages, losses, liabilities, and expenses arising from your Input, output, use of the Service, violation of these Terms, or violation of another person's rights.

15. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law principles. Any dispute not subject to a mandatory consumer-protection rule will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to those courts' jurisdiction.

16. Changes to these Terms

We may update these Terms. We will change the date above and provide additional notice, and obtain renewed agreement, when required by law. If you continue using Hatch after revised Terms become effective, you accept them to the extent permitted by law. If you do not agree, stop using the Service.

17. General

If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. Our failure to enforce a provision is not a waiver. Nothing in these Terms limits any warranty, remedy, or consumer right that cannot lawfully be limited or waived.
